In response, Montenegro enacted interim reforms in 2024 that restricted access to foreign betting sites and limited online payment options to credit cards or in-person transactions. This led to a reduction in the use of digital wallets and mobile banking for gambling.
Additionally, the government doubled the fixed annual fee for casinos to E€100,000 and enhanced enforcement measures, introducing stricter penalties for those who fail to comply.
March 2025 saw further changes as parliament quickly approved new advertising restrictions. These included a ban on gambling ads on both domestic and foreign television and radio from 06:00 to 22:00, even during live sports events.
The updated regulations also targeted misleading promotions, specifically prohibiting claims of guaranteed winnings or “free money” offers. Now, with the Ganes of Chance law, the country moves to an approval-based licensing system and looks to provide “greater legal certainty, clearly defined obligations, and more precise control and oversight,” according to the Ministry.
New Legislation Faces Criticisms From Industry Experts
The recently enacted Law on Games of Chance is already drawing significant criticism from industry stakeholders, especially from Montenegrobet, the national association of licensed operators.
They argue that the law acts as a “proclamation on expulsion,” introducing excessive and unrealistic demands, particularly regarding criminal liability and grounds for license revocation. These requirements could potentially destabilize the legal market.
In an interview with SBC, Stasya Yautodzyvea, Head of Market Insights at 4H agency, expressed additional concerns. She stated, “By removing key legal protections and introducing regulatory burdens out of step with EU standards, the law may unintentionally drive players and companies into the unregulated sector.”
The potential fallout could be severe, leading to widespread business closures, job losses, and reduced tax revenues, which could deter future investment. Yautodzyeva further noted that “Montenegro is already not a highly attractive destination for European gaming operators,” pointing out that the market lacks appeal compared to larger or more digitally advanced jurisdictions.
By imposing a more rigid and punitive legal framework, Montenegro risks undermining its domestic market and potentially losing out on licenses. This shift could transform a marginal jurisdiction into one that is “fundamentally unattractive.”
The full implementation of this legislation comes at a critical time for Montenegro, as the country aims to demonstrate its institutional competence while progressing toward EU growth, particularly in high-risk sectors.
